Public offer agreement for the sale of goods by the BOSYAK online store

1. General provisions

1.1. This document is a public offer of sole proprietor Savenko Mykola Tarasovych (Tax ID 3578304751, hereinafter the "Seller") within the meaning of Art. 633 and Art. 641 of the Civil Code of Ukraine and contains all essential terms of a distance sale of goods via the website bosyak.com.ua (the "Site").

1.2. The offer is accepted when the Buyer places an order on the Site or pays for it — whichever happens first. Acceptance means full and unconditional agreement to all terms of this contract without exceptions.

1.3. The Buyer may be a legally capable individual or a legal entity. Relations with a consumer Buyer are governed by the Law of Ukraine "On Consumer Rights Protection" and the Law of Ukraine "On E-Commerce".

2. Subject of the contract

2.1. The Seller undertakes to transfer to the Buyer pet goods of its own manufacture (beds, mats, accessories — the "Goods"), and the Buyer — to accept and pay for the Goods under this contract.

2.2. The characteristics of the Goods (model, fabric collection, size, colour, dimensions, materials) are stated on the product page. Item dimensions have a permissible tolerance of ±2–3 cm due to the sewing technology; such tolerance is not a defect.

2.3. Photo colour rendering may differ from the actual fabric colour depending on the Buyer's screen settings. The colour reference is the macro photo of the fabric sample (swatch) on the product page.

3. Personalization (branding)

3.1. The Buyer may order personalization of the Goods — printing the pet's name or another agreed text/image. The personalization cost is added to the price of the Goods and is shown before the order is placed.

3.2. The personalization text is produced exactly as entered by the Buyer at checkout. The Seller does not edit the spelling of the entered text.

3.3. Personalized Goods are made to the Buyer's individual order. Such Goods of proper quality are not subject to exchange or return (clause 7.4 of this contract).

4. Price and payment

4.1. Prices on the Site are in Ukrainian hryvnia (UAH) and include all taxes. The Seller applies no hidden charges or fees.

4.2. The price of the Goods is fixed at the moment the order is placed and cannot be changed unilaterally by the Seller after confirmation.

4.3. Payment methods:

4.4. Personalized Goods and Goods made to individual dimensions ship only after full payment.

5. Order, production and delivery

5.1. An order is placed on the Site or by phone at +380 73 446 47 20. After placement the Seller confirms the order by phone or message.

5.2. The Goods are made at the Seller's own workshop in Ukraine. Standard dispatch time is 1–2 business days from order confirmation (up to 4–5 business days for personalized items).

5.3. Delivery options: Nova Poshta (branch, parcel locker, courier), Ukrposhta, Meest, or pickup at the workshop at 11 Kaisarova St., Kyiv (Mon–Fri, 9:00–18:00). Delivery costs follow carrier rates and are paid by the Buyer unless the Site states otherwise.

5.4. Ownership of the Goods and the risk of accidental damage pass to the Buyer when the Goods are handed to the carrier (for pickup — upon receipt).

5.5. The Buyer must inspect the parcel on receipt. Damage to the packaging or the Goods is documented in a report drawn up with the carrier's representative at the moment of receipt.

6. Quality and warranty

6.1. The warranty period is 24 months from the date of receipt, provided the care instructions stated on the product page and the item label are followed.

6.2. The warranty covers manufacturing defects (seams, hardware, zippers). It does not cover natural fabric wear, damage by pets' claws/teeth, or consequences of washing against the care instructions.

6.3. Quality claims are sent to hello@bosyak.com.ua with photos of the defect and the order number. Review takes up to 14 calendar days.

7. Exchange and returns

7.1. The Buyer may exchange or return Goods of proper quality within 14 calendar days of receipt (Art. 9 of the Law of Ukraine "On Consumer Rights Protection") if the Goods were not used and their presentation, consumer properties and packaging are intact.

7.2. Delivery costs for exchanging/returning Goods of proper quality are borne by the Buyer. Money is refunded by the same method the payment was made, within 7 calendar days from the moment the Seller receives the Goods.

7.3. Goods of improper quality are replaced or refunded at the Seller's expense in accordance with the law.

7.4. Not subject to exchange or return (proper quality): Goods made to individual order, including personalized ones (clause 3.3).

7.5. The detailed procedure is on the Site's "Exchange and returns" page, which is an integral part of this contract.

8. Liability and force majeure

8.1. The Seller is not liable for the carrier's delivery times after the parcel is handed over, but assists the Buyer in tracing the parcel.

8.2. The parties are released from liability for the duration of force majeure circumstances (including hostilities, power outages, carrier disruptions) confirmed in the established manner.

8.3. Disputes are resolved by negotiation, and failing agreement — in the manner established by the legislation of Ukraine.

9. Personal data

9.1. By placing an order the Buyer consents to the processing of their personal data in accordance with the Privacy Policy published on the Site and the Law of Ukraine "On Personal Data Protection".

10. Other terms

10.1. The Seller may amend the terms of the offer; a new revision takes effect upon publication on the Site and does not apply to already confirmed orders.

10.2. The contract remains in force until the parties fully perform their obligations.
